AI-generated content is intended to assist users and should always be reviewed before publication.
3. User Accounts
You are responsible for:
• Maintaining the confidentiality of your account credentials.
• All activity conducted through your account.
• Keeping your account information accurate and up to date.
You must notify us immediately if you believe your account has been accessed without authorization.
4. Subscription Plans
Certain features require a paid subscription.

Payments are processed through the Apple App Store or Google Play.
Subscriptions automatically renew unless cancelled before the renewal date.

You acknowledge that AI-generated content:

• May not be unique.
• May require editing.
• May not reflect current laws, regulations, or platform policies.
AI-generated content is provided for informational purposes only and does not constitute legal, financial, tax, medical, or professional advice.
You are solely responsible for reviewing, editing, approving, and publishing any content generated by the Service.
7. User Content
You retain ownership of all content you upload, including text, images, logos, branding, and business information.
You grant MarketSprout AI a limited, non-exclusive licence to process your content solely for the purpose of providing the Service.
We do not claim ownership of your business content.
8. Social Media Integrations
MarketSprout AI may connect with third-party platforms including:
• Threads
• Google Business Profile
• TikTok
When you connect these services, you authorize MarketSprout AI to access and publish content on your behalf within the permissions you grant.
You remain responsible for complying with each platform's terms, community guidelines, and publishing policies.
9. Acceptable Use
You agree not to:
• Violate any law or regulation.
• Infringe intellectual property rights.
• Upload malicious software or code.
• Attempt to reverse engineer the Service.
• Interfere with the operation or security of the Service.
• Generate illegal, harmful, fraudulent, deceptive, or misleading content.
• Use the Service for spam, phishing, or other abusive purposes.
We reserve the right to suspend or terminate accounts that violate these Terms.
10. Intellectual Property
MarketSprout AI, including its software, branding, logos, graphics, user interface, and design, is owned by Saint Clair Appl and protected by applicable intellectual property laws.
Except as expressly permitted, you may not reproduce, modify, distribute, or create derivative works from any part of the Service.

• Firebase

• Google Play

Your use of those services is governed by their respective terms and privacy policies.
We are not responsible for third-party services or changes they make to their platforms or APIs.
12. Service Availability
We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation.
Features may be modified, suspended, or discontinued without notice.
13. Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE."
To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
AI-generated outputs may contain errors or omissions.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Saint Clair Appl and MarketSprout AI shall not be liable for:
• Lost profits.
• Business interruption.
• Loss of goodwill.
• Loss of data.
• Indirect, incidental, special, exemplary, or consequential damages.
• Any reliance placed on AI-generated content.
Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us for the Service during the twelve (12) months preceding the claim.
15. Termination
We may suspend or terminate your account if you breach these Terms or misuse the Service.
You may stop using the Service at any time.
Cancelling a subscription does not automatically entitle you to a refund except where required by law or the applicable App Store policies.
16. Changes to These Terms
We may update these Terms from time to time.
The updated Terms become effective when published.
Your continued use of the Service after the updated Terms are published constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of Victoria, Australia, unless otherwise required by applicable consumer protection laws.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
